We at Shadowney Irish Setters do not breed to sell puppies. We only breed when we are ready for a new puppy ourselves. We want a healthy puppy for ourselves and do not breed a litter without doing health clearances on the parents prior to breeding to help insure that not only do we get a healthy puppy but you also get a healthy puppy.

This questionnaire is provided to you to help us get to know you and to inquire into your interest in owning an Irish Setter. We would appreciate your answers to the following questions. The answers to the questions are important and most helpful in deciding the correct placement of each puppy with its new owner(s). Any litigation brought pursuant to this contract will be litigated in this venue.

Buyer(s) are responsible for transportation (airfare, if applicable) expense. Seller(s) will file registration and Home Again Micro-Chip paperwork with AKC and associated costs are to be paid for by Buyer(s).


SELLER(S)(s) offers a seventy-two (72) hour veterinarian check on DOG at Buyer(s)� expense. SELLER(S) agrees to a full refund or replacement and BUYER(S) shall relinquish the DOG to SELLER(S), should the dog be found not to be in good health when notified by BUYER(S)

Veterinarian, in writing, within seventy-two (72) hours of purchase. After 72 hours BUYER(S) shall assume full responsibility for the health, appearance, and temperament of the DOG. BUYER(S) also agrees to have DOG in their possession and to properly socialize, condition and exercise DOG to insure DOG�S proper mental and physical health. BUYER(S) agrees to adhere to the attached Vaccination/Worming/Feeding/ and Conditioning schedule as stated under separate cover. We also will stand behind any testable genetic health issue that may arise.


  1. This puppy is in good health as far as is known. The DOG is from parents that are blood-tested and found to be non-carriers of Progressive Retinal Atrophy. Both sire are O.F.A. certified free of hip dysplasia (Sire: Rated ( ) Excellent ( ) Good Dam: Rated ( ) Excellent ( ) Good and also free of Throid Disease. Parents have Clearance Certificates


    Should BUYER(S) wish to sell, place, or dispose of the DOG in any fashion at any time, SELLER(S) shall have �The First Right of Refusal..


  1. The AKC registration litter registration form has been forwarded to AKC for filing. All puppies will carry the kennel prefix of �Estrella� or �Shadowney� and the theme for the litter is �?�. The registration will be filed no later than 35 days after DOG has been placed with BUYER(S). The AKC registration of DOG does not guarantee that DOG will complete an AKC Championship.

  2. BUYER(S) agrees to socialize and/or enroll DOG in a basic obedience class to become knowledgeable and understand the importance of consistent training and control of DOG. If BUYER(S) fails to accomplish this (without just cause) BUYER(S) may be in violation of this contract and all guarantees herein offered shall become null and void.

  3. BUYER'(s) agree that DOG will be a house DOG and will not be left in an unprotected and unsafe place when no one is home. DOG will NOT be chained. DOG will be provided a safe FENCED yard and not be allowed to roam.

  4. When DOG is twenty-four (24) months old, BUYER(S) will have DOG�S hips x-rayed for an evaluation by a veterinarian that is qualified by the ORTHOPEDIC FOUNDATION FOR ANIMALS (OFA). The findings of the OFA are to be sent to SELLER(S). Annually, beginning at one (1) year of age DOG shall have a thyroid test. Thyroid test to be evaluated by a facility of like standing to Michigan State University Veterinarian Hospital or HEMOPET (Jean Dodds, DVM) and a written report or copy thereof sent to SELLER(S).

  5. If by (2) years DOG develops any disqualifying show faults as defined in the official AKC Breed Standard, or DOG is not certified by OFA at 24 months old as having normal hips for breeding, BUYER(S) may utilize any of the following options. (Not applicable for pet homes)

  1. A reduced fee of one-half of purchase price of another dog from SELLER(S)�s next available litter, and after BUYER(S) shows proof to SELLER(S) that DOG has been rendered sterile.

  2. If BUYER(S) wishes to sell DOG after DOG is rendered sterile, BUYER(S) must notify SELLER(S) before DOG is sold and placed in a new home. BUYER(S) reserve the right to work with SELLER(S) in the selection of an appropriate new home for DOG. There shall be no monetary compensation to BUYER(S) by SELLER(S). The sale shall constitute a refund.

  3. If DOG�S hips are evaluated by OFA as having crippling hip dysplasia SELLER(S) will offer a replacement dog of equal value from SELLER(S)�s next available litter.

  4. We will take a back dog for any reason at any age.


  1. If BUYER(S) breeds DOG before DOG�s hips have been preliminary x-rayed clear before the age of two (2) years, and/or certified by OFA as being normal, SELLER(S) shall have the right to redeem DOG from BUYER(S) for no fee as BUYER'(S) actions shall be deemed a direct violation of this Contract. If DOG is a female, BUYER(S) may keep all resulting pups from this breeding, however SELLER(S) shall have the same right to redeem DOG from BUYER(S) for no fee as BUYER'(S) actions shall be deemed a direct violation of this Contract.



8. The following terms and conditions will apply regarding full and co-ownerships between SELLER(S) and BUYER(S):

if DOG is a male:

  1. BUYER(S) agrees that SELLER(S) will have stud service privileges at no fee to bitches owned or co-owned by SELLER(S). SELLER(S) agree to pay expenses incurred
    (i.e. board, veterinary expenses, services by BUYER'(S) agent) should DOG be maintained by BUYER'(S) agents.

If DOG is a female:

  1. Upon mutual agreement between BUYER and SELLER(s), SELLER(S) has the right to assist in the selection and approval of any stud dog that BUYER(S) chooses to breed to DOG for the first litter. SELLER(S) will take second choice puppy from the first breeding at no cost to SELLER(S) and at that time will sign off dog giving the buyer sole ownership.

  1. BUYER'(S) agrees that SELLER(S) may show DOG in the breed ring (conformation) from time to time and to obtain his/her Championship title. The breeding that produced this DOG is of the finest quality and it would be a disservice to the breed and the SELLER(S) if DOG were not given this chance. Fees, such as handling fees, and expenses (i.e. travel, entry fees) to be determined at the applicable time. BUYER(S) and SELLER(S) agree to work together in arranging the pick-up of DOG from BUYER(S) by SELLER(S) and return of DOG to BUYER(S) by SELLER(S) on the applicable show dates. It is highly recommended that BUYER(S) work DOG in a basic obedience class, preferably with an instructor who utilizes the positive reward training techniques.

  2. BUYER(S) agrees to never breed DOG to any Irish Setter with the following health issues and faults:

  1. non-OFA certified;

  2. PRA carrier

  3. Serious health issues (i.e. PDA)

  4. with any disqualifying faults (i.e. bad bite);

  5. not fully AKC registered.


11. BUYER(S) further agrees to not offer DOG�S services as a prize in a raffle, or to breed this DOG to any Irish Setter who is owned by a known wholesaler of animals. If herein named DOG is a female, BUYER(S) agrees to never offer her puppies for sale to a pet shop, in a litter lot, or to an animal wholesaler.

12. The name Shadowney may not be used on any puppies without SELLER(S)�s written permission.

13. If, within thirty (30) days of receiving DOG, BUYER(S) decides not to keep said DOG, 100% of the purchase price will be refunded upon return of DOG in good condition and verified by a vet as to the DOG's health status.

14. Under no circumstances is any part of the purchase price refundable on DOG except for the specific clauses listed herein. Under no circumstances is this contract transferable to another party. SELLER(S) shall recognize only those parties named in this contract as having any claim on any guarantees listed herein.


MISCELLANEOUS PROVISIONS.


  1. This Contract, having been prepared in and delivered in the State of Oregon, its validity, interpretation, performance and enforcement shall be governed by the laws of that state.

  2. Each provision of this Contract is intended to be severable. If one or more of the provisions of this Contract shall for any reason be held invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect or impair any other provisions of this Contract, but this Contract shall be construed as if such invalid, illegal or unenforceable provision had not been contained herein.



SELLER(S) SHALL HAVE THE RIGHT TO CHECK IN ON DOG TO ASSURE THAT THIS DOG IS BEING KEPT IN GOOD PHYSICAL HEALTH AND CONDITION. IF DOG IS FOUND TO BE IN POOR HEALTH, SELLER(S) HAS THE RIGHT TO TAKE DOG TO A LICENSED VETERINARIAN FOR EVALUATION AND/OR TREATMENT. SELLER(S) SHALL THEN HAVE THE RIGHT TO REDEEM DOG WITH NO MONEY REFUNDED TO BUYER(S), AS THIS MISTREATMENT SHALL BE DEEMED A VIOLIATION OF THIS CONTRACT. BUYER(S) DOES AGREE TO MAKE THIS DOG A PART OF THE FAMILY BY NOT KEEPING DOG OUTDOORS AT ALL TIMES. THIS Five (5) PAGE SALES CONTRACT HAS BEEN READ BY BOTH THE UNDERSIGNED BUYER(S) AND SELLER(S) AND THEIR SIGNATURES AFFIXED HEREON SHALL ATTEST TO THEIR COMPLETE AGREEMENT AND UNDERSTANDING OF THE CONTENTS HEREIN. THERE ARE NO VERBAL PROMISES OR BOTH PARTIES SHALL HONOR COMMITMENTS OFFERED TO BUYER(S) ON THIS DOG, ONLY THOSE GUARANTEES LISTED HEREIN. THIS SHALL BE DEEMED A LEGAL AND BINDING CONTRACT AND FAILURE TO COMPLY WITH ITS TERMS AND CONDITIONS COULD RESULT IN A LEGAL ACTION BEING FILED, WITH THE PARTY AT FAULT BEING RESPONSIBLE FOR ANY LEGAL FEES INCURRED BY THE OPPOSING PARTY. IF BUYER(S) IS FOUND TO BE IN VIOLATION OF THIS CONTRACT AND SELLER(S) LEGALLY REDEEMS DOG, BUYER(S) AGREES TO SIGN OVER TO SELLER(S) THE OFFICIAL AKC REGISTRATION OF DOG(S) AS SOON AS A JUDGMENT HAS BEEN MADE BY THE COURT.
